These Terms and Conditions of Use are intended to define the terms of use of the website https://rushbee.agency (the “Site”) operated by the company Team Vitality SAS (“Team Vitality”), by any person consulting this site (the “User”).
MODIFICATION OF THE TERMS AND CONDITIONS
Team Vitality reserves the right to modify the Terms and Conditions at any time. Generally, the User is invited to consult the Terms and Conditions prior to each use of the Site. By accessing the Site, the User is deemed to have accepted without reservation or restriction any modifications that may have occurred.
ACCESS TO THE SITE AND SERVICES
Team Vitality strives to allow access to the Site and the Service 24 hours a day, 7 days a week. Team Vitality declines any responsibility in the event of failure, interruption, or alteration of access to the Site resulting from force majeure, computer difficulties, difficulties related to telecommunications networks, or any technical difficulties whatsoever.
Team Vitality reserves the right to temporarily suspend access to the Site without notice, in particular for maintenance reasons, without being held liable for any direct or indirect damage that may result, including unavailability or loss of data for the User.

LIABILITY
By using the Site, the User acknowledges:
being responsible for any kind of damage, material or immaterial, direct or indirect, caused to any third party, including Team Vitality, as a result of the illegal use or exploitation of the Site, regardless of the cause and location of such damage, and guarantees Team Vitality against the consequences of any claims or actions that may result;

INTELLECTUAL PROPERTY
The Site as well as any software necessarily used in connection with it may contain confidential information and be protected by the applicable intellectual property law or any other law. As such, all intellectual property rights on the documents contained on the Site and each of the elements created for this Site are the exclusive property of Team Vitality. The trademarks and other intellectual property rights mentioned on the Site are the property of Team Vitality.
The use of all documents/content (texts, software, audio documents, photographs, videos, and drawings that appear or are available from the Site) published on the Site is authorized solely for the exclusive purpose of personal and private information use; any reproduction or use of copies made for other purposes is expressly prohibited unless expressly authorized by Team Vitality. It is also prohibited to copy, modify, create a derivative work, reverse engineer or assemble, or otherwise attempt to discover the source code (except to the extent permitted by law), sell, assign, sublicense, or transfer in any way any rights related to the Site or the content available on it. USE OF THE SITE BY MINORS
If the User is a minor, they may not use the Site without first obtaining authorization from their legal guardian(s), who must have accepted to be responsible for compliance with these Terms of Use.
If applicable, any registration forms to subscribe to a service must be completed by the legal guardian of the minor User. Otherwise, the registration will not be valid.
Any use of the Site by a minor User is carried out under the full responsibility of the legal guardian(s) of the concerned User.
PERSONAL DATA
Team Vitality informs Users that personal data (first name, last name, email address, information appearing on résumés) collected on the Site is subject to computerized processing for information, recruitment, and newsletter sending purposes. Connection data may be processed for purely statistical purposes. Data is also collected through Cookies placed in the Users' browsers during their consultation of the Site. The purposes and recipients of the processing resulting from the collection of personal data are detailed in the Personal Data Policy, as well as the data retention periods, the rights of the data subjects, and the conditions for exercising those rights. NEWSLETTER
If applicable, Team Vitality may send registered Users marketing emails ("prospecting") containing information to help them better understand and use the Site and learn more about the services offered. The User will have the possibility to object, free of charge (except for the cost of transmitting the refusal), to the use of their personal data for this purpose, both at the time of collection and each time a marketing email is sent to them, in particular by clicking the unsubscribe link at the bottom of each newsletter.
SEVERABILITY
If any provision of the Terms is declared null or void under a legislative or regulatory provision in force and/or a final court decision, it will be deemed unwritten and will not result in the nullity of the other provisions.
APPLICABLE LAW – DISPUTES
These Terms are governed by French law. In the event of any dispute, the courts within the jurisdiction of the Paris Court of Appeal shall have exclusive jurisdiction to hear the matter.
